PRIVACY STATEMENT

The software esd.next is managed by External Staffing Desk B.V. (registered under Chamber of Commerce number: 52695352). This Privacy Statement provides an overview of the purposes of the data processing in relation to this software. In other words: what do we do with your data? When using the software, External Staffing Desk may process your data (e.g. collection, storage and consultation). This mainly concerns data that is registered in your personal account. In the context of these processing operations, External Staffing Desk guarantees and respects your privacy, among other things by complying with the Personal Data Protection Act and the General Data Protection Regulation, which has come into effect as of May 2018. This means, among other things, that your personal data is protected by External Staffing Desk and that you can exercise certain rights with regard to your personal data. Purposes of data processing External Staffing Desk collects and processes personal data for various purposes. These purposes all relate to the general provision of (automated) services in the field of job placement. Below we've specified for each main function of esd.next the reason why we collect personal data.

Applicant Tracking System (ATS):

  • To find and match candidates with assignments and vacancies based on matching characteristics;
  • To approach professionals via personalized e-mails and other (social) media;
  • To easily import candidate CV's via 'drag & drop' and to parse and categorize them in order to build a database with talent pools of professionals;
  • To process received applications, such as inviting or rejecting candidates;
  • To present candidates quickly and tailor-made with their CV and profile to our clients;
  • To generate, capture and follow up on offers to selected professional(s).

Contract management:

  • With regard to the registration of all conditions (such as rate, duration, billable unit and compliance rules) that may be attached to the contract with the professional and that must be used by the system;
  • To generate, format, approve and store the correct contracts with the parties involved;
  • For digitally sending the final contract via a 'token link', with which the document can be downloaded and approved at the touch of a button;
  • For downloading and uploading of contracts.

Compliance:

  • For recording, modifying and removing default compliance rules at different levels;
  • To support on-boarding processes so that professionals can get off to a smooth start with their new client;
  • For checking compliance per assignment and client: through automatic reminders, proposed follow-up actions and work lists.

Timesheet:

  • For everything that is necessary for a professional to justify their delivered work to the client and to have it approved as a basis for sending, receiving, processing and paying Invoices. Administration & Invoicing:
  • For the automatic generation of invoices to internal or external clients or employers as a result of approved time units and contract rules or as a result of a completed recruitment & selection project;
  • For processing and posting incoming invoices from contractors; manually or automatically via XML feeds or other links with accounting software;
  • To automatically generate payments to professionals or contractors as a result of approved time units and contract conditions.

Other purposes:

  • To support products or services that you have purchased from us;
  • For marketing purposes, only if you have given permission for this;
  • If we are legally obliged to do so.

Permission

If required by law, we will ask your permission for the processing of your personal data. We will also inform you in advance about how you can withdraw the given consent.

Consequences of non-provision of data in the case of agreements

If you purchase products and services from us and you enter into an agreement with us in that context, then not providing your personal data can have various consequences. For example, we cannot present your CV to our clients, or send you an official order confirmation in the form of a contract.

Sharing data with third parties

External Staffing Desk does not sell your information to third parties and will only provide it if this is necessary for the execution of the agreement with you or to comply with a legal obligation. With companies that process your data on our behalf, we close a processing agreement to ensure the same level of security and confidentiality of your data. External Staffing Desk remains responsible for these processing operations.

Security of personal data

External Staffing Desk takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you feel that your data is not properly secured or there are indications of abuse, please contact us.

Retention periods

Your personal data will never be kept longer than is strictly necessary to achieve the purposes for which your data is collected.

Newsletter

We offer specific newsletters with which we want to inform interested parties about our services and products and related matters. Your e-mail address will only be added to the (specific) list of subscribers for which you have registered with your explicit permission. Every newsletter contains a link with which you can easily unsubscribe. This will remove you completely from our subscriber file. We will only keep your e-mail address to the extent necessary for compliance with our legal obligations, for resolving disputes and for executing our agreements. The subscriber file of the newsletter is not provided to third parties.

Cookies

In order for the software to function better and faster and to be able to tailor it to your preferences, certain data regarding your use of the software is collected. This information can be collected by using so-called (functional) "cookies". These are small text files that are automatically placed on your computer by the visited web page. You can disable the use of cookies via the settings of your browser. However, some functionalities of the site may become unavailable.

Third-party websites

This Privacy Statement does not apply to applications or websites of third parties that can be visited via links in the software or to which reference is made from the software.

Your rights

When you have provided us with personal data, you have various rights that you can exercise. For example, you have the right to access, rectify and delete your personal data. In addition, you have the right to object to the processing of your data and you have the right to complain to the Dutch Data Protection Authority.
